Article 32 <br /> To see if the Town will amend the zoning by-law by amending footnote 14 of the <br /> Section 174-31 Land Space Requirements Table to read as follows: i <br /> is Minimum front building setback from Routes 28 and 151, from Great Neck <br /> Road South and North and from Route 130 west of Great Neck Road (except <br /> within the Mashpee Center Overlay District) shall be seventy-five (75) feet and, <br /> except for permitted signs and one (1) access driveway involving clearance of a <br /> path no more than forty (40) feet in width, the first fifty (50) feet of the front <br /> setback area shall be left wooded and in its natural state, except that said area <br /> may be reduced by the Special Permit Granting Authority as part of its decision on <br /> a special permit approved under Sections 174-45.1 or 174-46. Where such area <br /> is not naturally wooded, it shall be suitably planted with sufficient trees and <br /> understory vegetation, of a type common in natural areas of Mashpee, to <br /> replicate a naturally wooded area and to constitute a visual barrier between the <br /> proposed development and the roadway. Under no circumstances will parking, <br /> retention ponds, or any other development involving clearance of natural <br /> vegetation be permitted within said area. Umited, appropriate tree surgery or <br /> i <br /> similar limited maintenance required to protect the health of vegetation in this <br /> area may be allowed with the approval of the special permit authority which <br /> originally authorized the project which included said area or, if no special permit <br /> was required, with the approval of a majority of the Planning Board." <br /> and by adding a reference to footnote 14 in the C-2 row of the front setback column <br /> of said Table, <br /> or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would prevent removal of existing natural vegetation in 50 <br /> foot buffer areas along Routes 28 and 151 and Great Neck Road South and North <br /> within commercial zoning districts. The bylaw currently allows"landscaping"within <br /> this buffer area, which has resulted, in some cases, in clearcutting of the natural <br /> vegetation and replacement with minimal landscaping inconsistent with the woodland <br /> character of Mashpee's landscape.
