V l�r+;c� e 3 <br /> §174-24. Explanation of symbols used in Table of Use Regulations. <br /> A. Explanations. <br /> ii <br /> (1) A use listed in §174-25 is permitted as of right in any district under which it is denoted by the <br /> letter"Y,"subject to such requirements as may be specified elsewhere in this chapter. <br /> (2) A use which is denoted in §174-25 by the letters "PR" may be permitted as a right subject to <br /> the provisions of Subsection B and to such other requirements as may be specified elsewhere <br /> in this chapter. <br /> (3) A use which is denoted in §174-25 by the "SP" is permitted as a special exception only if a <br /> special permit is granted by the Planning Board or Board of Appeals, as applicable,pursuant <br /> to the provisions of Subsection C and is furthermore subject to such other requirements as <br /> may be specified elsewhere in this chapter. <br /> (4) A use which is denoted in §174-25 by the letters "PR/SP" shall be permitted as a special <br /> exception only if a special permit is granted by the Planning Board or Board of Appeals, as <br /> applicable, pursuant to the provisions of Subsection C, except that if such use does not <br /> involve construction of a building or addition containing more than one thousand (1,000) <br /> square feet of gross floor area, it shall be permitted as of right subject to the provisions of <br /> Subsection B and such other requirements as may be specified by this chapter. However, <br /> construction, additions or land alteration involving a nonconforming use may be allowed only <br /> as a special exception by the Board of Appeals [Amended 10-1-1990 ATM, Art. 4, <br /> approved 12-18-19901 <br /> c _ <br /> (5) Absence of any designation on the.table in§174-25 means that the use listed is not permitted. <br /> B. Where a use is denoted in§174-25 by the letters"PR,"it shall be subject to a plan review as follows <br /> or,at the choice of the applicant, it shall otherwise require a special permit subject to the procedures <br /> of Subsection C. <br /> (1) The applicant shall submit a request for a plan review to the Building Inspector on an <br /> application form determined by the Building Inspector, along with sufficient plans and <br /> documentation to fully describe the proposed use and/or structure and its site. A minimum of <br /> seven (7) copies of such plans and documentation shall be submitted, along with any fees <br /> which may established by the Board of Appeals for such plan review. The applicant shall ( � <br /> also transmit, by registered mail, a notice of said application to any abutters (as they appear <br /> on the most recent applicable tax assessment list) within three hundred (300) feet of that <br /> portion of the structure or site which is the subject of the plan review. <br /> (2) The Building Inspector shall forthwith transmit copies of such application, plans and <br /> documentation to the Health Agent, Town Planner, Conservation Officer, Fire Chief, Police <br /> Chief and Director of Public Works and shall secure a receipt from each indicating the date on <br /> which said items were received. <br /> i <br /> (3) Within fourteen (14) days of receiving such application, plans and documentation from the <br /> Building Inspector,the Health Agent,Town Planner, Conservation Officer, Fire Chief,Police <br /> Chief and Director of Public Works,or their appointees, shall review said plans to determine <br /> whether they are consistent with applicable state and town regulations, bylaws and plans and <br /> will not adversely affect public health or safety, will not significantly decrease surface or a <br /> groundwater quality or air quality, will not have a significant adverse impact on wildlife <br /> habitat, estuarine systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br /> neighboring properties and will not destroy or disrupt any species listed as rare,endangered or <br /> threatened by the Massachusetts Natural Heritage Program or any known historic or <br /> archaeologic site.
