Article 24 <br /> To see if the Town will vote to appropriate $850,000 for unanticipated costs related <br /> to the acquisition,of land for the new Mashpee High School, including appraisals and <br /> other costs incidental or related thereto, and to determine whether to raise said <br /> supplemental appropriation by borrowing, transferring available funds or otherwise, <br /> or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article proposes to appropriate $850,000 to pay for unanticipated <br /> land acquisition costs for the Mashpee High School complex. The original <br /> appropriation for project land acquisition costs was based upon appraisals of the <br /> various parcels of land comprising the Mashpee High School tract prepared in 1994, <br /> prior to the actual eminent domain taking of the subject parcels. Subsequent to the <br /> land takings, four legal actions were commenced in Barnstable Superior Court <br /> seeking assessment of further damages with respect to said land takings. The <br /> proposed supplemental appropriation will be utilized to effect a settlement of the last <br /> two pending land damage cases, which are scheduled for trial in July 2000. The <br /> principal and interest payments for the supplemental appropriation will be excluded <br /> from the calculation of the Town's levy limit in the same manner as other Mashpee <br /> High School capital costs pursuant to the debt exclusion referendum passed by the <br /> Town for this project in 1993. <br /> Recommendation: The Finance Committee recommends approval. <br /> Motion to be made by Fred Blythe. <br /> Motion: I move the Town hereby appropriate the sum of$850,000 to pay additional <br /> costs related to the acquisition of land for the new Mashpee High School, including <br /> appraisals and other costs incidental or related thereto, and that to meet this <br /> appropriation, the Treasurer, with the approval of the Selectmen, is hereby <br /> authorized to borrow said amount under and pursuant to Chapter 44, Section 7(3) of <br /> the General Laws, Chapter 645 of the Massachusetts Acts of 1948, as amended, or ` <br /> any other enabling authority, and to issue bonds or notes of the Town therefor. <br /> If <br /> Com- <br /> y, <br /> t1 <br /> s k'; <br /> 24 <br />
