Article 31 <br /> To see if the Town will vote to authorize the Selectmen and/or Conservation Commission to <br /> grant a conservation restriction and/or management easement on that parcel of land identified on <br /> the 1999 Mashpee Assessors' Maps as Map 98, Block 1, consisting of 12.37 acres, more or less, <br /> located between Holland Mill Road, Old Ockway Road and "Coombs Avenue" and shown on a <br /> "Plan of Land in Mashpee, Mass. prepared for Heirs of Maurice F. Greaney", dated October 6, <br /> 1989, by Schofield Brothers, Inc. Registered Land Surveyors, which has been purchased and held <br /> in the care and custody of the Conservation Commission pursuant to Mass. General Laws <br /> Chapter 40, Section 8C under the provisions of the vote under Article 23 of the warrant for the �a <br /> October 2, 2000 Annual Town Meeting, to the Commonwealth of Massachusetts Division of <br /> Fisheries & Wildlife under terms and for compensation which are agreeable to the Board of <br /> Selectmen and Conservation Commission, and to enter into contracts or agreements with the <br /> Massachusetts Division of Fisheries & Wildlife in connection with said restriction and/or <br /> easement and execute any and all instruments as may be necessary on behalf of the Town to <br /> effectuate said restriction and/or easement; and finally, to authorize the Selectmen to petition the <br /> General Court for special legislation authorizing the Town to enter into said restriction and/or R <br /> easement, or take any other action relating thereto. <br /> Submitted by Open Space Committee <br /> Explanation: This article would authorize the Board of Selectmen and Conservation <br /> Commission to sell a conservation restriction or management easement to the Massachusetts <br /> Division of Fisheries & Wildlife on a parcel of land purchased by the Town with Land Bank <br /> funds. This restriction/easement was anticipated at the time of the October 2000 Town Meeting, <br /> but the Town has since learned that it cannot be done without approval by the state legislature <br /> under the requirements of Article 97 of the state constitution. The October Town Meeting article <br /> did not authorize the Selectmen to seek the necessary legislation.
