authorize the Board of Selectmen to convey such parcels for such affordable housing purposes, <br /> and to make use of other instrumentalities of the Town or other agencies and to enter into any <br /> agreements necessary, to effect the transfer of such land in accordance with this vote. <br /> Motion to amend made by Frank Homeyer. <br /> Motion: To see if the Town will vote that those parcels shown on the 2001 Mashpee Assessors' <br /> Maps as Map 62, Blocks 28 and 29 shall not be held for the Town as conservation land; and <br /> further, vote to authorize the Selectmen to transfer for no consideration to the Mashpee <br /> Affordable Housing Trust for the construction on such land, under the "Local Incentive <br /> Program"the building of affordable housing within the meaning of the Housing Act of 1937, and <br /> qualifying for listing in the affordable housing inventory maintained by the Mass. Housing <br /> Appeals Board under G.L. Chapter 40B, with such transfer to be made subject to a permanent <br /> deed restriction, which contains a reverter clause, permanently restriction the sale or use of said <br /> property for anything other than affordable housing as defined by the U.S. Dept. of Housing and <br /> Urban Development and qualified for continued listing in the above affordable housing <br /> inventory; and finally voted to authorize the Board of Selectmen to petition the General Court for <br /> special legislation authorizing such transfer and restrictions, to make use of other agencies and <br /> instrumentalities of the Town, including but not limited to the Mashpee Housing Authority and <br /> to enter into any agreements necessary,to effect the transfer of such land in accordance with this <br /> article. <br /> Motion to amend passes at 8:20 p.m. <br /> Amended motion passes by 2/3rds vote at 8:20 p.m. <br /> Article 14 <br /> To see if the Town will vote to amend the zoning bylaw by replacing Subsection 174-45.2B.(4) <br /> with the following: <br /> "(4) In addition to the Dimensional Requirements specified in §174-25E.(11), a twenty (20) foot <br /> vegetative buffer containing adequate screening given the character of the neighborhood and the <br /> intensity of the use shall be provided between adult entertainment uses and abutting commercial <br /> uses, if any." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would fix an error in the existing Zoning By-law by providing the <br /> correct reference to the Table of Use Regulations section for Adult Entertainment Uses, which is <br /> §174-25E.(11). The letter E had been left out. <br /> Planning Board voted at a Public Hearing held on September 18, 2002 4-0 for approval. <br /> Motion made by George Green. <br />
