It is my <br /> understanding that the Town Clerk has forwarded the Article to your office for review along <br /> with a letter stating that Mashpee Town Counsel ruled that Article 22 was defective because it <br /> did not comply with Town of Mashpee Bylaw Article I, § 40-8 and or Town of Mashpee <br /> Bylaw Article XVII, § 174-97 in that Article 22 was not accompanied by a Survey Plan or <br /> geographic description and diagram of the geographic area proposed to be changed or altered. <br /> For the following reasons, the Office of the Massachusetts Attorney General, Municipal Law <br /> Unit, should overrule Mashpee Town Counsel's determination that Article 22 fails to comply <br /> with Mashpee Bylaws and should approve Article 22 as being consistent with State and local <br /> law: <br /> 1. Petition Article 22 is not in violation of Town of Mashpee Bylaw,Article I, �40-8. <br /> Town of Mashpee Bylaw Article I, § 40-8 governs the creation or alteration of a <br /> zoning area. The Bylaw, by its express terms, contemplates the creation or alteration of the <br /> zoning in a geographic area that would alter or create new geographic areas on the Town of <br /> Mashpee Zoning Map. Article 22 does not create or alter the geographic configuration of an <br /> area. Rather, Article 22 changes the zoning within an already mapped and surveyed <br /> geographic area. Accordingly,there is no rational basis for applying Town of Mashpee Bylaw <br /> Article I, §40-8 to Article 22 because Article 22 does not change the parameters of an existing <br /> zoning area or undertake to create a new one. A survey would be a pointless repetition of <br /> what is already clearly defined on the official Town of Mashpee Zoning Map,a copy of which <br /> is attached.
