"C-1-SV" and"C-1-O"Districts to the"C-1"District as shown on"a map entitle [sic] "C-3 <br /> Limited Commercial District Zoning Amendment" dated October 2000 which was on file in the <br /> Office of the Town Clerk. In the materials submitted to us for review, we were not provided <br /> with a copy of the amended town zoning map. In approving these changes to the zoning map, we <br /> remind the town that the new map must be submitted to our Office for review and approval in <br /> accordance with G.L. c. 40A, §§ 4 and 5. General Laws Chapter 40A, Section 4,provides in <br /> pertinent part: <br /> Districts shall be shown on a zoning map in a manner sufficient for identification. <br /> Such maps shall be part of zoning ordinances or by-laws. <br /> Section 4 requires zoning districts to be shown on the zoning map of the town, and such <br /> map is part of the town's zoning by-laws. Therefore, any changes to the district boundaries or <br /> the adoption of a new map must be accomplished by town meeting via a zoning by-law <br /> amendment. G.L. c. 40A, §§ 4 and 5. This means that the updated zoning map of the town must <br /> be submitted to our Office for review and approval. <br /> Lastly, we point out that our review and approval is limited to substantive consistency <br /> with the Constitution and laws of the Commonwealth, and does not address their consistency y <br /> with the town's local laws. We suggest that you consult with the Town Attorney to confirm that <br /> the amendments are consistent with local law. We offer this caution because during our review <br /> of the town's by-law amendments, we received several letters suggesting procedural or <br /> substantive inconsistency with the town's existing by-laws. <br /> Very truly yours, <br /> THOMAS F.
