i <br /> F: <br /> Where the need exists for an Economic Development and Industrial Corporation because <br /> unemployment or the threat thereof exists in the Town or that security against future <br /> unemployment and lack of business opportunity is required and that attracting new industry <br /> into the Town and substantially expanding existing industry through an economic development <br /> project or projects financed pursuant to Mass. General Laws Chapter 121C and implemented by <br /> such a corporation would alleviate the unemployment and lack of business opportunity <br /> problems, the Board of Selectmen is hereby authorized.to establish the Mashpee Economic <br /> Development and Industrial Corporation, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article is a revote of Article 21 of the May 2001 Town Meeting. Corrective <br /> language was needed in order to file for special legislation. <br /> Article 5 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase, eminent <br /> domain, gift or otherwise, for the purposes identified in Chapter 293 of the Acts of 1998 (An Act <br /> Relative to the Establishment of the Cape Cod Open Space Land Acquisition Program), all or a <br /> portion of certain parcels of land shown on the 2000 Mashpee Assessors' Maps as Map 23, <br /> Blocks 20, 24, 30, 36, 42, 46, 48, 49, 51, 54, 56, 57, 66, 68 and 212, Map 30, Blocks 52, 53, <br /> 84, 85, 87, 88, 91, 94, 97, 104, 105, 107, 108, 111, 138, 139 and 140 and the land contained <br /> in the layouts of the"paper"streets known as Wimbledon Way and Racquet Drive, Map 31, <br /> Block 1, Map 37, Block 55, Map 38, Blocks 1, 5, 6, 7, 9, 10, 11, and 25, Map 47, Block 21 and <br /> Map 51, Block 5, as well as those parcels of land shown on the Town of Barnstable Assessors' <br /> Maps as Map 11, Parcels 1, 2 and 3, Map 12, Parcel 8 and Map 26, Parcels 1, 40-1, 41, 42 and <br /> 46 and the land contained in the layout of the"paper"street known as Wimbledon Way, along <br /> with those portions of adjacent street layouts which are appurtenant to any of said parcels; and <br /> further, to see if the Town will vote to raise and appropriate, or transfer from available funds, <br /> $3,200,000 for such purpose, including expenses incidental and related thereto, and to raise <br /> such appropriation, the Treasurer, with the approval of the Selectmen, be authorized to borrow <br /> $3,200,000 or any other sum under and pursuant to Chapter 44, Sections 7 and 8C of the <br /> Massachusetts General Laws, or any other enabling authority, and to issue bonds or notes of <br /> the Town therefor; with said borrowing to be repaid with funds from the Land Bank Fund <br /> established by the Town under the provisions of Chapter 293 of the Acts of 1998 (An Act <br /> Relative to the Establishment of the Cape Cod Open Space Land Acquisition Program); and <br /> further, to see if the Town will vote to raise and appropriate or transfer from available funds <br /> $20,000 to the Issuance of Debt Account; and further, to see if the Town will authorize the <br /> Board of Selectmen to apply for and accept Federal, State and / or County grants, to be applied <br /> by the Town toward the financing of this purchase, and to enter into contracts or agreements <br /> with Federal, State and / or County agencies, municipalities, private conservation trusts or other <br /> entities or persons in connection with the purchase and management of such land and its <br /> preservation for conservation purposes, including the grant of conservation restrictions on the <br /> land; and finally, to see if the Town will authorize the Board of Selectmen to enter into <br /> agreements and execute any and all instruments as may be necessary on behalf of the Town to <br /> effectuate said acquisition, sale, transfer or preservation; or take any other action relating <br /> thereto. <br /> Submitted by Board of Selectmen <br /> March 4,2002 <br />
