parcel to those uses deemed appropriate by the Board of Selectmen and subject to certain design <br /> guidelines and other conditions which the Board may deem appropriate; and finally, to authorize <br /> the Board of Selectmen to make use of other instrumentalities of the Town or other agencies and <br /> to enter into any agreements necessary to affect the transfer of such land in accordance with this <br /> Article, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the selectmen to lease or sell a parcel of land <br /> containing approximately 2.44 acres,previously taken by the Town for non-payment of taxes, to <br /> an appropriate non-profit entity, which may include a greenhouse as well as a residential home <br /> for the disabled. The land would be permanently restricted to uses deemed appropriate by the <br /> Board of Selectmen (and would also have to conform to applicable zoning), with design and <br /> other conditions specified by the Selectmen, and would'be transferred to an agency or <br /> organization selected through a "Request for Proposals"process. Under the provisions of <br /> Chapter 5, Article VI, Section 5-27 of the Town Code, such a transfer of tax title lands may only <br /> occur after the Town has voted whether or not such land should be held as conservation land. <br /> This article therefore includes a vote that the land shall not be held as conservation land. <br /> I` <br /> Motion to dispense with reading of Article 18 made at 8:53 p.m. <br /> Motion to dispense with reading of Article 18 passes at 8:53 p.m. I <br /> Motion made by John Cahalane. <br /> Motion: I move the Town vote that the parcel of land shown on Mashpee Assessors' Maps as Map 93, <br /> Block 9 not be held by the Town as conservation land; and further, vote that said parcel shall be <br /> transferred from the care and custody of the Tax Collector for the purposes of sale, to the Board of <br /> Selectmen, for purposes of sale or lease to a non-profit entity with such transfer to be made subject to a <br /> deed restriction, which may contain a reverter clause, restricting the use of said parcel to those uses <br /> deemed appropriate by the Board of Selectmen and subject to certain design guidelines and other <br /> conditions which the Board may deem appropriate; and finally, vote to authorize the Board of <br /> Selectmen to make use of other instrumentalities of the Town or other agencies and to enter into any <br /> agreements necessary to effect the transfer of such land in accordance with this Article. <br /> Motion made by Jason Brooks to amend section to read shall contain a reverter clause at 8:56 <br /> p.m. <br /> Selectman Cahalane asked for legal opinion. <br /> Town Counsel: Mr. Moderator in my opinion the motion to amend is proper and may be voted <br /> on. �.. <br /> Motion made to amend Article 18 passes with a majority at 8:56 P.M. <br /> Amended motion passes by 2/3rds vote at 8:56 p.m. <br /> October 20, 2003 Town Meeting <br />
