a <br /> Explanation: This parcel of land is currently abutted by conservation land, a homeowners <br /> association, and a well-site,owned by the South Cape Resort Condominium Association. To <br /> build homes that would abut the well-site may have an adverse impact on the quality and/or <br /> supply of water for South Cape Resort. <br /> Article 29 <br /> To see if the Town will vote to amend the Town By-Laws by adding thereto a new Section <br /> 4.5.1.c. as follows: <br /> i <br /> Section 4.5.1.c. <br /> C. Any person who is the owner, keeper, or individual having responsibility for a dog shall <br /> insure that such a dog is not a nuisance by reason of excessive howling or barking for a <br /> duration longer than 15 minutes any time during the day or night. <br /> I ' <br /> For the purpose of this By-Law nuisance shall be defined as"a source of annoyance to sick or <br /> convalescing persons residing in the vicinity and disturbing a person or persons reasonable right <br /> to peace or privacy by making loud or continuous noise by barking or howling, which is plainly <br /> audible off of the premises." <br /> Whoever violates the provisions of this By-Law upon a first offense in a calendar year shall be <br /> issued a verbal warning, upon any subsequent violation within said calendar year will be <br /> assessed a fine of Fifty ($50.00) dollars. <br /> Or take any other action thereon. <br /> Submitted by Petition <br /> Explanation: We the undersigned petition the board of selectmen to amend the current <br /> barking laws. The current law we consider to be a "part-time" law and does not pertain to all of <br /> the Taxpayer's working schedules. We also feel that it is not a fair quality of life for the Animal. <br /> Article 30 <br /> That the administration of the Town of Mashpee and the various subdivisions and departments <br /> recognize that veterans have certain rights to include but not limited to the 1993 employment <br /> and re-employment rights act, for town employees called to active military service in the armed <br /> forces, to include the Coast Guard, National Guard and Militia by order of the Governor of the <br /> Commonwealth or the President of the United States. <br /> That the administration of the Town of Mashpee and the various subdivisions and department <br /> heads make diligent efforts to ensure that veterans rights under state and federal law to include <br /> but not limited to assignments, re employment and health care be fostered and promoted for <br /> town employees called to active military duty and or returning from said duty. <br /> Submitted by Petition �� <br /> I <br /> ' I l <br /> i <br /> d. <br /> 24 <br />
