Town of Mashpee Charter <br /> Adopted May 8, 2004 <br /> ARTICLE 1 <br /> INCORPORATION; SHORT TITLE; DEFINITIONS , <br /> r <br /> SECTION 1-1:INCORPORATION <br /> The inhabitants of the Town of Mashpee, within the territorial limits established by law, shall <br /> continue to be a municipal corporation, a body corporate and politic, under the name "Town of <br /> Mashpee." <br /> SECTION 1-2:SHORT TITLE <br /> This instrument shall be known and may be cited as the Mashpee Home Rule Charter. <br /> SECTION 1-3:DIVISION OF POWERS <br /> The administration of the fiscal, prudential and municipal affairs of Mashpee, with the <br /> government thereof, shall be vested in an executive branch consisting of a board of selectmen, <br /> elected by and responsible to the voters and a town manager, appointed by and responsible to the <br /> board of selectmen; and a legislative branch consisting of a town meeting open to all voters. <br /> lj <br /> SECTION I-4:POWERS OF THE TOWN <br /> Subject only to express limitations on the exercise of any power or function by a municipal " <br /> government in the constitution or in the general laws of the Commonwealth,it is the intention and <br /> the purpose of the voters of Mashpee through the adoption of this charter to secure for themselves <br /> and for their government all of the powers it is possible to secure as fully and as completely as <br /> though each such power were specifically and individually enumerated herein. <br /> SECTION 1-5: CONSTRUCTION <br /> Theowers of the Town of Mashpee under this charter are to be construed liberally p p yin favor of <br /> the town, and the specific mention of any particular power is not intended to limit the general <br /> powers of the town as stated in section 14. <br /> SECTION 1-6:INTERGOVERNMENTAL RELATIONS <br /> Subject only to express limitations in the constitution or general laws of the Commonwealth, <br /> Mashpee may exercise any of its powers or perform any of its functions, and may participate in <br /> the financing thereof,jointly or in cooperation,by contract or otherwise,with the Commonwealth <br /> or any agency or political sub-division thereof, or with the United States government or any <br /> agency thereof. <br /> SECTION 1-7:DEFINITIONS <br /> Unless another meaning is clearly apparent from the manner in which the word or phrase is used, <br /> the following words and phrases as used in this charter shall have the following meanings: <br /> (a) Appointing Authority- The words "appointing authority" shall mean the officer or <br /> multiple member body, which appoints the officer, member of a multiple member <br /> body or town employee. ' <br /> (b) Charter- The word"charter" shall mean this charter including any amendment to it <br /> hereafter adopted. <br /> 1 <br />
