Town of Mashpee Charter <br /> Adopted May 8, 2004 <br /> ARTICLE 3 <br /> EXECUTIVE BRANCH: ELECTED OFFICERS , <br /> SECTION 3-1 IN GENERAL <br /> (a) Elected Town Offices-The town offices to be filled by the voters shall be a board of <br /> selectmen, a school committee, a town clerk, a board of library trustees, a town <br /> moderator and a planning board. <br /> (b) Other Offices Filled at Town Elections -In addition to the town offices enumerated <br /> above, members of a housing authority and such other officers or representatives to <br /> regional authorities or districts as may be established by law or by interlocal <br /> agreement may also be filled by ballot at town elections. <br /> (c) Eligibility - Any voter shall be eligible to hold any elective town office, provided <br /> however, no person shall simultaneously hold more than one elected town office or <br /> hold any appointed town office except as an ex officio member of a multiple member <br /> body. <br /> f . <br /> (d) Town Election -The annual election of town officers and for the determination of all <br /> questions to be referred to the voters, shall be held on such date as may from time to <br /> time be provided by by-law. <br /> (e) Ballot Position - The names of candidates for each elective town office, and <br /> including candidates for re-election to the same office, shall be arranged according to <br /> the results of a drawing, by lot, conducted by the town clerk to which the candidates <br /> or their representatives shall be invited to attend. <br /> ()9 Compensation - Elected town officers shall receive such compensation for their <br /> services as may be appropriated, annually, for such purpose, but, no elected officer <br /> regularly employed for fewer than twenty hours during the regular work week <br /> otherwise established for town employees shall be considered an employee for <br /> purposes of receiving group insurance benefits. <br /> (g) Coordination and Cooperation -Notwithstanding their election by the voters, the <br /> town officers named in this section shall be subject to the call of the board of <br /> selectmen or of the town manager, at all reasonable times, for consultation, <br /> conference and discussion on any matter relating to their respective offices. <br /> (h) Filling of Vacancies in Elected Offices <br /> (1) Multiple Member Body-If there is a vacancy in a board consisting of two or <br /> more members, other than the board of selectmen and unless under the terms <br /> of a will or other trust some other provision is made,the remaining members <br /> shall forthwith give written notice of the existence of any such vacancy to the <br /> board of selectmen. After one week's notice of the date on which the vote s <br /> shall be taken, the board of selectmen with the remaining members or <br /> member of such board shall fill such vacancy by a joint vote.If such notice is ' <br /> not given within thirty days following the date on which said vacancy occurs <br /> the board of selectmen shall, after one week's notice, fill such vacancy <br /> without participation by the remaining members of the multiple member <br /> 8 <br />
