ten (10) days after the date of such notice. Within seven (7) days after <br /> the public hearing, the Chief of Police or his/her designee shall make an <br /> order either revoking or suspending such kennel license or otherwise <br /> regulating the operation of said kennel, or shall dismiss such petition. <br /> (3) Within ten (10) days after receiving such determination and order of the <br /> hearing officer the holder of the kennel license may bring a petition in the <br /> District Court praying that such order be reviewed by the District Court. <br /> (4) The Animal Control Officer may periodically inspect the premises where <br /> the kennel license has been revoked and shall institute court proceedings <br /> if he/she finds that the kennel continues to be maintained on the <br /> premises. <br /> C. Penalties. Whosoever violates any provision or portion thereof of this by-law <br /> shall be fined: <br /> (1) Twenty-five dollars ($25) for the first offense. <br /> (2) Fifty dollars ($50) for the second offense. <br /> (3) Seventy-five dollars ($75) for the third offense. <br /> (4) One hundred dollars ($100) for each subsequent offense, such fine to be <br /> assessed on a per-dog-found-on-the-premises basis of said violator. Each <br /> day on which any violation exists shall be deemed to be a separate <br /> offense. <br /> §79-16. Enforcement. <br /> Enforcing persons for this Article are the Animal Control Officer, Health Agent or the <br /> Chief of Police or his/her designee, <br /> or take any other action relating thereto. <br /> Submitted by the Animal Control Officer <br /> Explanation: Town meeting approval of this article will introduce a new level of animal <br /> control across the town. Currently the town has no official guidelines relative to the <br /> keeping and housing of multiple dogs. Acceptance of this by-law will provide dog <br /> owners, non-dog owners and town officials with a written set of rules and regulations <br /> designed to protect the publics' health and safety. <br /> Article 34 <br /> To see if the Town will vote to amend Chapter 79, Article II, §79-8, of the Mashpee <br /> Code, Licensing of dogs; Other Animal Regulations to read as follows: <br /> Submitted by the Animal Control Officer <br />
