§51-5. Scope of Bylaw. This Bylaw is intended to be construed and implemented in accordance with and consistent with provisions of applicable Massachusetts General Laws, and the Regulations promulgated thereunder, relating to the operation of All Terrain Vehicles, including, but not limited to, the provisions of G.L. c.90B, §§20-35 and 323 C.M.R 3.01, et seq., as amended., or take any other action relating thereto. Submitted by Board of Selectmen Explanation: The Town has experienced a significant and growing problem of illegal use of all-terrain motor vehicles on Conservation lands and other public and private properties. This article is intended to provide for clear and enforceable regulation of all- terrain vehicle use in the Town. Article 45 To see if the Town will vote to amend the General Bylaw of the Mashpee General Code pertaining to Public Records and Open Meetings, 38-3-1 to add subsection e) to read as follows: e) Regulatory Boards, Commissions, and Committees shall post 24 hours prior to their scheduled meeting an agenda for that meeting to the town website. Within 10 business days following each meeting the minutes of the meeting shall be posted to the Town's website in draft format. Final versions shall be posted to the website after the Boards'/Committees/Commissions'approval and shall remain on the website for a period of not less than six months Submitted by Petition Explanation: As the purpose of the original bylaw was to ensure open access to public records and meetings, to provide for adequate disclosure of matters concerning the public interest and the accountability of Town Boards, Committees and Commissions; and to provide for strengthened local control and enforcement of the Commonwealth's Open Meeting law; as this bylaw provided for accomplishing the-above through written reports/agendas and through audio sound records; as this bylaw was passed on May 3, 2003 by the Town Meeting; as the Town and residents are increasingly using the Town Website for dissemination of information and for communication, the proposed amendment to General Bylaw 38-3-1 adds the town website as a required location for posting Town Regulatory Board, Committee and Commission agendas and minutes.
