TOWN OF MASHPEE
Petitioner: James A, McDonald
Hearing: June 12, 1973
Mashpee Town Hall
8,30 PM
Appeals Board:
Peter M. Lawrence
Clara Keliinui
Kevin D. O'Connell
FACTS
The petitioner filed a Special Permit and Variance to construct 96 two bedroom
condominium units on 21.79 acres of land located on the northerly aide of
Ashumet Road, between Ashumet Road and Route 130. The project land is located
in an R-1 zoning district and is bordered on the North by 2.63 acres of
industrially zoned land, and to the East by 6.82 acres of commercial 2 zoned
land. The land has 1,669.20 foot frontage on Ashumet Road. The project land
is triangular in shape and includes an area to the South of Ashumet Road
containing 10.97 acres.
DECISION
The Board feels that the 10.82 acres to the North of Ashumet Road and the
10.97 acre parcel to the South of Ashumet Road are not contiguous parcels.
Also the Board finds that the requested number of units (96) is considerably
above a satisfactory number considering the shape of the project parcel or
parcels. In discussing the density problem with the petitioner's representative,
it was agreed that the number of units shall be reduced to 64.
The Board in granting the Special Permit for 64 condominium units does 50 with
the following restrictions:
A. The 2.63 acre industrial parcel may be used only for the well site for
water supply. No building shall be allowed on this parcel, nor any future
development. The parcel shall be left as a "green area".
B. The parcel to the South of Ashumet Road containing 10.97 acres shall remain
as a common area. No building shall be allowed on the parcel. The parcel may be
used for recreational purposes providing all plans for such are submitted to and
accepted by the Board of Appeals, Board of Health, and Building Supertendent.
C. The construction of the 64 units shall commence with the issuance of the
building permits and no phasing will be required.
D. The swimming pool shall be completed during the initial building stages.
E. All cat back, frontage, and parking requirements shall be based upon
current zoning laws of the Town of Mashpee as presented in the 0 llow
proposal, a copy of which is filed herewith. /
Vote:
Lawrence - yes
Keliinui - yea
O'Connell - yes
