JR. <br /> May 16 , 1973 <br /> Planning Board <br /> Mashpee, Massachusetts <br /> Gentlemen: <br /> zona Nemetz, Trustee of Cape Cod Land Development Trust, has <br /> referred to me your letter da -ed May 2, 1973 addressed to her in <br /> which you notified her of the denial of approval of a definitive <br /> plan of the Section C , Santuit Woods , subdivision and conferred , <br /> with me regarding her rights relating thereto . <br /> She has also referred to me the copy sent to her of the letter <br /> from Charles N . Savery, Inc . .ilso dated May 2 , 1973 , addressed <br /> to the Planning Board (copy attached hereto marled "A" ) . <br /> In reviewing the contents of both letters as well as the' <br /> I plan and profiles as corrected since , provision of the following <br /> quoted portion of Massachusetts General Laws Chapter 41, Section 81-U <br /> are hereby invoked and, since items 2 through 7 have been <br /> remedied, it is respectfully requested that the Board revoke its <br /> disapproval referred to in your letter of May 2, 1973, and approve <br /> the subject plan: - <br /> I <br /> _ " . . .In the event of disapproval , the Planning <br /> Board shall state ii detail wherein the plan <br /> does not conform to the rules and regulations <br /> of the Planning Boacd . . .and shall revoke its <br /> disapproval and approve a plan which, as <br /> amended, conforms to such rules and regulations . . . " <br /> It would appear that iter #1 was inserted through inadvertence <br /> because the Town Clerk received, on April 4 , 1973, notice of <br /> submission of the subject plan on March 21, 1973 . A photostat <br /> copy of the receipt therefor is attached hereto marked "B. " <br /> Mrs. Nemetz has further informed me that her linens of the <br /> plan have apparently become lost or misplaced . I have caused <br /> this 'difficulty to be resolved and am furnishing the Board with <br /> a replacement thereof together with three sets of prints of the <br /> profile plans as amended . <br />
