-, THE COMMONWEALTH OF MASSACHUSETTS ' <br /> TOWN OF MASHPEE <br /> D®Al2D OF APPEALS <br /> •...--..------------ June 11---------------19:n.... <br /> Decision of the Board of Appeals on the appeal and petition of.............................................. <br /> Mr. and Mrs. Joseph Murphy <br /> ....................................................... ------'----'---------------...........................----.....---.........................................--- <br /> Hearing: April 17, 1973 <br /> Time: 7:30 p.m. <br /> Place: Mashpee Town Hall <br /> Petitioner: Mr. and Mrs. Joseph Murphy <br /> FACTS <br /> On October 25, 1972 Mr. Joseph Murphy applied for and was, issued a building permit <br /> for a structure at 538 Triton Way+ New Seabury. <br /> On March 28, 1973 the building inspector determined that the house was in violation <br /> of Sec. 2.24 and Sec. 2.25 of the 1971 Zoning By-Laws concerning stories and Sec. 7.3 <br /> concerning height restrictions. <br /> On April 2, 1973 a petition was received by the Appeals Board stating that Mr. and Mrs. <br /> Murphy were aggrieved of a decision of the building inspector concerning the above <br /> . mentioned Sections. <br /> A hearing was held April 17, 1973. The Board of Appeals and the Building Inspector <br /> determined that the Murphy House was 32 feet in height from natural grade and well <br />' - below the 35 foot restriction from sill to ridge. <br /> Section 2.25 of the Zoning By-Laws of the Town of Mashpee states: <br /> "That portion of a building next beneath a sloping roof and in which <br /> there are less than 4 feet vertically between the top of the floor <br /> and the intersection of the bottom of the rafters with the interior <br /> faces of the wall". <br /> At the time of inspection of the structure by the Appeals Board and the Building <br /> Inspector, the rear knee wall was 4 feet 8 inches in height. The front wall <br /> was 8 feet in height. The board directed the petitioner to move the rear knee wall <br /> back to a height of four feet and to move the roof line forward 8 feet 8 inches until <br /> a knee waAA of 4 feet in height was created at the front of the house. Also we <br /> directed that the 12 foot slider be replaced by an 8 foot slider, thereby,bcreating <br /> a reverse dormer at the front of the structure, and enclosing the sides of the <br /> existing deck. <br /> FORM 1095 HOBBS 8 WARREN, INC.
