r,
4.
14. The land in question is not at all suitable for residential
house lot development because of its peculiar location. It is bordered
on the West by the Otis Trailer Village; on the North by a large gravel
pit and a U. S. Government easement zone which prohibits human
habitation; on the East and South by Moody Pond, swamps, cranberry
bogs, uninhabited woodland, Otis Air Force beach and parking lot and
a beach on John's Pond used by Otis Trailer Village.
These surrounding conditions as well as the hilly nature of
the terrain make the land unsuitable and undesirable for residences.
These special conditions are peculiar to this parcel of land and do not
generally affect other land in the same district.
A strict enforcement of the Zoning By-Law would involve a
substantial hardship on the applicant. He has a large financial
investment in this land. By placing this land in a residential district
and then absolutely prohibiting the use of the land for a Trailer Park
or Mobile Home Park, this By-Law is effectively depriving the applicant
of the best and possibly only use of his property without any compensation
and is unconstitutional and invalid.
The granting of the requested variance would result in no
injury or detriment to the public good. The use would be compatible
to that of the adjoining Otis Trailer Village. All sites will be well
maintained and supervised in strict compliance with local and state
health regulations. The land for the most part would remain in its
natural wooded state in keeping with current environmental concerns,
which would be greatly beneficial to the public good.
The granting of the requested variance would in no way
derogate from the intent and purpose of the Zoning By-Law. As
previously stated, the preservation of the land in its natural state would
be a far more appropriate use of the land than cutting down the trees
and bulldozing the land for use as residential lots. There would be
little if any increase in traffic, fire or health hazard for the Town
and no undue concentration of population. It would certainly encourage
the most appropriate use of this particular parcel.
