TONIN OF MASHPEE
Board c Appeals
October 23, 1974
SUBJECT: Decision of the Board of Appeals on the appeal and
Petition of : Whit:chall Co. , Ltd. , for a Variance
under the Zoning By-Law.
HEARING: October. 23, 1974 - 7 : 30 p.m.
FACTS : The petitioner has requested a Variance to the Front
Minimum Yard Depth (setback) requirements in an
Industrially zoned district (an I district) . The
property is, located on Echo Road, off Route 130.
The locus is Three Hundred (3001 ) feet in depth and
Four Hundred (4001 ) feet wide. The reau.ired minimum
Front Yard Depth (setback) is One Hundred fifty
(150 ' ) feet;, and the minimum Rear Yard Depth is
Fifty (50 ' ) ; feet. Petitioner is requesting a Variattoe'
to allow a structure (warehouse) to exist with a
Front Yard Depth of Sixty (60 ' ) feet.
DECISION : In view of the fact that the lot is ,only Three Hundred
(300 ' ) feet in depth, and the total minimum yard
requirements are Two Hundred (2001 ) feet, .it is our
decision that this amounts to a condition especially
affecting this parcel and that a literal 'en-rcment
of this provision of the Town of I4ashpee Zetiing by-Lawwould involvc substantial haidship to the 'aplellant
We further believe that by granting this Variance
there will be no detriment to the public cjood and that
this decision is in no way nullifying or derogating
from the intent or purpose .of any Zoning By-Law ix:
the '?own of Mashpee.
VOTE : UNANIIdOUS /J
f •A. i :, r;, r lig. . t t. /' ', /KT.i r •t ,,t
Clara L.
