TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Re : Application of Kenneth S. Peterson for a variance of <br /> sideline requirements under Land Space Requirements , <br /> Section 7.1 <br /> FACTS <br /> A petition was duly filed by the Petitioner for a vari- <br /> ance to Section 7.1 of the Zoning By-Law as pertains to mini- <br /> mum sideline requirements in a residentially zoned area. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws , Chapter 40A as amended by <br /> Chapter 808 of the Acts of 1975. Notice was given by publi- <br /> cation by publishing in the Falmouth Enterprise , a newspaper <br /> of general circulation in the Town of Mashpee on November 18, <br /> 1977 and November 25 , 1977 , a copy of which is attached hereto <br /> . and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, December 7 , 1977 at 7 : 30 p.m. at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout: Clara L. Keliinui , Chairman; <br /> Michael Makunas , Vice Chairman ; and Linda Edson Hendricks. <br /> The Petitioner presented a plan of the garage he proposed <br /> to erect on his property at 133 Woodland Avenue , Mashpee , <br /> Massachusetts. The garage , if built as proposed, would not <br /> meet the 15 foot setback requirements from his sideline. The <br /> garage would be 6 feet from the sideline.
