Several abutters, including a representative of the Poponessett
Beach Association spoke in opposition to the petition. A show of
hands of those present at the hearing indicated-that none were in
favor of the petition and 17 were opposed.
Upon motion duly made and seconded, the Board voted unanimously
to deny the petition for the following reasons :
1. The Petitioner never applied for and therefore was not
denied a Building Permit .
2. The Zoning Bylaw specifically provides in Section 4 . 4 that
"there shall be not more than one principal building on any lot . . . "
Any variance from that Bylaw would be of substantial detrement to
the public good and derogate from the intent and purpose of the Bylaw.
3• The Petitioner failed to show that literal enforcement
of the Zoning Bylaw would involve substantial hardship, financial
or otherwise to the Petitioner .
R E c;.
