McInerney �'.� <br /> M <br /> DECISION + <br /> A petition was duly filed by the petitioner for a variance <br /> to Section 7.4 Land Space Requirements of the zoning by-law as pertains <br /> to side line requirements in R-2 zoned area. <br /> Notice was duly given to abutters and owners of land next <br /> adjoining the land of abutters. Notice was also given by publication <br /> in the Falmouth Enterprise, a newspaper of general circulation in the <br /> Town of Mashpee on February 13, 1976 and February 20, 1976, a copy of <br /> such notice being appended hereto. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, March 3, 1976 at 7:30 p.m. at which time the following <br /> members of the Board ofAppeals were present: Michael Makunas , Acting <br /> Chairman; David Keene; Linda Hendricks. <br /> The petitioners' property consisted of land and dwelling <br /> located on Lot #12 on Pembroke Drive in the section of town called <br /> Popponesset Beach. The dimensions of this lot are 90 feet fronting <br /> on Pembroke Drive, depth of 100 feet containing 9000 square feet of <br /> land. The petitioner is asking for a 10 foot side line variance in <br /> order to add 20 feet to the easterly side of the existing building which <br /> would consist of one and one-half stories with a single garage beneath. <br /> No objections to the granting of a variance were received <br /> prior to or during the public hearing. Written notice in favor of <br /> granting a variance was received by Mr. John J. Kelleher and Dr. William <br /> T. Davison, both abutters. <br /> It was unanimously voted by the Appeals Board to grant a variance <br /> from sideline set back requirements to permit the extension of the existing <br /> dwelling on Lot ,#12, Pembroke Drive so as to make a 10 foot side line set- <br /> back on the easterly lot line. <br /> Under provisions of Chapter 40A, Zoning Enabling Act as amended, <br /> petitioner is required to record this variance at Barnstable County Registry <br /> of Deeds and satisfy any an . all costs related thereto. <br /> r <br /> BOARD OF APPEALS: <br /> MAY 1 ,r is Michael A.
