3. Zoning District: Residence Zoning District <br /> R-2. <br /> 4. How long has Appellant owned property: <br /> Since June, 1975. <br /> 5. Present use of property: Vacant lot, <br /> 6. Size of proposed building: 2 story wood frame <br /> building, 34- 1[2 feet by 71 feet, <br /> 7. Proposed use of premises : A single family <br /> residence. <br /> 8. Additional facts : ' By letter dated December 23 <br /> 1975, the Building Inspector, to whom <br /> ' plans had been submitted, refused to issue <br /> Appellant a building permit. <br /> , 9. Grounds of appeal and reasons for variance: <br /> A. The Building Inspector, in deciding <br /> that a septic system was a structure <br /> within the meaning of G.L. c. 40A and <br /> s. 2.28 of the zoning by-law, acted <br /> erroneously. A septic system is not <br /> a combination of materials available <br /> at a fixed location to give support <br /> or shelter. <br /> B. The Building .Inspector, in deciding <br /> that a septic system cannot be built <br /> on Lot No. 457, acted erroneously. <br /> The effect , if any, of a deed restric- <br /> tion is of no concern to the Building <br /> Inspector. <br /> C. The Building Inspector, in deciding <br /> (if he did) that the easterly yard <br /> depth was insufficient, acted <br /> erroneously. Lots 2 and 457 must be <br /> combined in determining the easterly <br /> yard depth. <br /> D. The Building Inspector, in deciding <br /> that the sale of Lots 2 and 457 was <br /> illegal, acted erroneously. Mrs . <br />
