Dilis <br /> DECISION y <br /> A petition was duly filed by the petitioner <br /> for a variance to Section 7. 4 Land Space Regulations of <br /> the Zoning By-law as pertains to side line requirements <br /> in an R-1 zoned area. . <br /> Notice was duly given to the abutters and owners <br /> of land next adjoining the land of abutters. Notice was given <br /> by publication by publishing in the FalmouthEnterprise, ' <br /> newspaper of general circulation in the town of Mashpee, on <br /> February 13 , and February 20, 1976. A copy of such notice <br /> .being appended hereto. <br /> A .public hearing was held on the petition at <br /> "the Mashpee *Town Hall on March 3 ; 1976 at eight P.M. at <br /> which time the following members of the Board of Appeals <br /> were present: <br /> Michael Makunas, acting chairman; B. Jean <br /> Thomas- and Linda Edson Hendricks. <br /> The petitioner' s property consists of land located <br /> on Lot 10, Pond View Road, Popponesset Beach, Mashpee. <br /> The dimensions of the lot are 80 feet by .100 feet, a total <br /> area of 8 , 000 square feet. The petitioner is proposing to <br /> erect a -12 feet by 20 feet garage, which would encroach the j <br /> side line requirement by 11 feet .to the westerly side line. <br /> The only objection came in the- form of a letter <br /> from a Mr. John J. Galvin, owner of lot .8 , Pond View Road, <br /> Popponesset Beach, Mashpee, which is the 'lot to the westerly <br /> side of Lot 10 , the Dilis ' s.- He was in fear that the garage <br /> would block his view of the water.
