3 . The dust, fumes , odors, smoke and vapor produced by <br /> the manufacturing of bituminous concrete and the manufacturing of <br /> concrete cannot be effectively confined to the premises where the <br /> aforementioned buildings are proposed for construction. <br /> 4. The manufacturing of bituminous concrete and concret <br /> at the proposed location of the buildings referred to in the afore - <br /> mentioned building permits will constitute a nuisance in violation <br /> of the Zoning By-Law of the Town of Mashpee. <br /> 5. The manufacturing of bituminous concrete and the <br /> manufacturing of concrete are not permitted. under the Zoning By- <br /> Law of the Town of Mashpee in a Commercial C-2 zoning district. <br /> 6. Gilmore Paving & Contracting, Inc. failed to comply <br /> with the requirements of Section 14 of the Town of Mashpee Zoning <br /> By-Law and specifically with respect to the provisions of Section <br /> 14. 1 and 14.2 thereof. <br /> Dated this 25th day of March, 1976. <br /> JOHN C.
