Gessner for a Variance Case #V-81-4-011 <br /> A Petition was filed by Gilmore G. Gessner of Falmouth, <br /> !f Massachusetts for a Variance under Section 9.31. 9.32. and 9.322 for <br /> permission to construct sixty-eight (68) condominium.units ,oniproperty <br /> located off Route 28, at 'Wags Road (Falmouth side of Rotary) Map 81, <br /> part of parcel #1, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with .4 ' <br /> Massachusetts General laws, Chapter 40A. Notice was given by publication <br /> in the Falmouth Enterprise, a newspaper of general circulation in the <br /> Town of Mashpee, on March 31, 1981 and April y, 1981, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 15, 1981, at 8:00 p.m, at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Robert J. Houle, Chairman, Michael Makunas, John Slavinsky. <br /> The Petitioner made the presentation to the Board, explaining <br /> the request for a variance to construct sixty-eight (68) multi-family <br /> dwellings in an R-3 Zoning District. Indicating on various renderings <br /> presented to the Board, the Petitioner felt that the proposal would be <br /> more advantageous to the Town than single-family dwellings. <br /> The Board found that the Petitioner established, to the <br /> satisfaction of the Board, a hardship unique to the particular property. <br /> The Board also established that granting the Variance would <br /> not be detrimental to the Town, and would be in harmony with the general <br /> purpose and intent of the ordance or By-law. <br />
