By <br /> purchasing a 18.5 x 130 foot strip from its Westerly abutter, the <br /> well and spetic system would not be on abutters property. The strip <br /> and new lot created would be an undersized lot however. Thus a hard- <br /> ship was clearly established. <br /> Petitioner has also agreed to create a 100' diameter cul-de-sac <br /> at the end of Gia Lane to improve the health and safety aspects of <br /> the area. He has agreed that if the Planning Board or Land <br /> Court makes substantial changes on the plans he will return to the <br /> Board of Appeals with this information. <br /> The Board also established that granting the Variance would not <br /> be detrimental to the Town, and would be in harmony with the general <br /> purpose and intent of the ordinance or By-law. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for variance as required. <br /> MASHPEE BOARD OF APPEALS <br /> BY: <br /> In Favor ./f <br /> Ropert J. ktoale <br /> In Favor a s <br /> ch 1 Makiin <br /> In Favor <br /> Peter V.
