Realty Corporation - Case #V-81-3-008 <br /> 3 <br /> A Petition was filed by D. S. & B. Realty Corporation of <br /> Hyannis, Massachusetts for a Variance under Section 9.31, 9.321, and <br /> 9.322 for permission to construct 30 two-bedroom luxury waterfront <br /> condominiums on property located off Great Oak Road, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General laws, Chapter 40A. Notice was given by <br /> publication in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on February 1' . 1981, and <br /> February 24, 1981, a copy of which is attached hereto and made a - <br /> part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, March 4, 1981, at 8100 p.m., at which time <br />" the following members of the Board of Appeals were present and acting <br /> throughoutt Robert J. Houle, Michael Makunae, Peter Lawrence. <br /> Mr. George Benway, representing the Petitioners, explained <br /> that the Petition was to request a Variance of the required twenty acre <br /> minimum parcel size to construct thirty luxury condominium units. The <br /> subject property contains 18.93 acres. The original plan was approved <br /> for thirty single-family lots, in 1972. <br /> The Board found that the Petitioner established, to the <br /> satisfaction of the Board, a hardship unique. to the particular property. <br /> The Board also established that granting the Variance would <br /> ,1 <br /> not be detrimental to the Town, and would be in harmony with the general <br />
