TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PAg DECISION <br /> Rel Petition of Joseph Tarabelli for a Variance Case #V-81-4-013 <br /> A Petition was filed by Joseph Tarabelli, of Mashpee, <br /> Massachusetts for a variance under Section 7.4 0£ the land Space <br /> Requirements for permission to vary the minimum set back requirements <br /> on property located on Lot #39 Wheel House Lane, Little Neck Bay, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was also given. <br /> by publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on April 14, 1981, and April <br /> 21, 1981, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 29, 1981 at 8130 p.m. at which ':time <br /> the following members of the Board of Appeals were present and <br /> acting throughout) Robert J. Houle, Michael Makunas, Raymond G. <br /> Sweeney. <br /> The Petitioner made the presentation to the Board, <br /> explaining that a variance of the minimum set back requirements <br /> would be necessary in order to construct a single family dwelling, <br /> within the requirements of both the Conservation Commission (Wetlands <br /> Act) and the Town Zoning By-laws. <br /> Upon motion duly made and seconded the Board voted <br /> unanimously to grant the request for a variance on Lot #39, to <br /> allow the house to be set back thirty-three (33) feet, as opposed <br /> to forty (40) feet. <br /> Y. <br />
