TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PAg <br /> DECISION <br /> Re: Petition of Joseph Tarabelli for a Variance -,Case #V-81-5-015 t <br /> A petition was filed by Joseph Tarabelli of Mashpee, <br /> Massachusetts for a variance under Section 7.4 of the land Spade- <br /> Requirements, for permission to vary the minimum set back requirements <br /> on property located on Lot 57, Keel Way, Little Neck Bay, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General laws, Chapter 40A. Notice was also given by <br /> publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on May 5, 1981 and May 12, 1981, <br /> a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, May 20, 1981, at 8:00 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Robert J. Houle, Chairman, Michael Makunas, Peter Lawrence. <br /> The Petitioner made the presentation to the Board, <br /> explaining that the lot was purchased with the understanding that the <br /> present set back requirements did not apply in Little Neck Bay, and a <br /> building permit had been issued. The Petitioner also explained that the •a <br /> plan had been approved by the Conservation Commission, and a DEQE Number <br /> has been issued. <br /> Upon motion duly made and seconded the Board voted <br /> unanimously to grant the request for a variance, as requested by the, <br /> Petitioner, to vary the set back requirements from forty feet (40' ) to <br /> thirty feet (30' ). <br /> J <br />
