Warwick for a Variance.- Case <br /> A petition was filed by William M. Warwick, of North <br /> Falmouth, Massachusetts, for a variance under Section 7.4 of.the land <br /> Space Requirements for permission to vary the minimum frontage set back <br /> requirements on property located on Lot 30, Waterline Drive, North, <br /> Little Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was also given by <br /> publishing in the Falmouth Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee on May 5, 1981, and May 12, 1981, a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, May 20, 1981 at 8130 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Robert J. Houle, Chairman, Michael Makunas, John Slavinsky. <br /> The Petitioner made the presentation to the Board, <br /> indicating the location of the property on the plan submitted to the <br /> Board. The Petitioner explained that in order to comply with the Conservation <br /> Commission Easement, and to conform with the variance already issued by the <br /> Board of Health, is was necessary to obtain a variance from the Board of <br /> Appeals, to vary the set back requirements from forty feet (40' ) to thirty <br /> feet (30' ). The Petitioner also indicated that upon approval=cf the variance <br /> by the Board of Appeals, it would still be required to present the plans to <br /> the Conservation Commission for approval. <br />
