TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> rqi; co- <br /> DECISION <br /> Re: Appeal of John O. Harris from a Decision of the Building Inspector <br /> A Notice of Appeal was filed by John O. Harris of Mashpee, Massachusetts from an <br /> order of the Building Inspector contained in a letter dated May 7, 1981 concerning the <br /> construction of a tower and generator upon Mr. Harris' property located at 45 James <br /> Circle, John's Pond Estates, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws, <br /> Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on June 16, 1981 and June 28, 1981, a copy of <br /> which is attached hereto and made a part hereof. <br /> A public hearing was held on the appeal at the Mashpee Town Hall on Wednesday, <br /> July 1, 1981, at 8:00 p.m. at which time the following members of the Board of Appeals <br /> were present and acting throughout: Robert J. Houle, Chairman, Raymond G. Sweeney <br /> and Peter Lawrence. <br /> At the hearing, Mr. Harris explained that he was granted a building permit in <br /> February; that he began construction of the footings at the end of April; and that <br /> subsequently the Building Inspector issued a letter dated May 7, 1981 that all work be <br /> stopped. <br /> Mr. Herman Drees, President of Pinson Energy testified as to the tower and <br /> indicated that its total height would be 89 feet. <br /> Several abutters to the property spoke in opposition to the construction of the tower <br /> expressing concerns of safety, television interference, aesthtics and noise. <br /> -1- <br />
