1 <br /> 1 y <br /> TOWN OF MASRPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Res Petition of David F. McKay for a Variance <br /> A Petition was filed by David F. McKay of Hyannis, Massachusetts, <br /> requesting a Variance under Section 7.4 - 3 of the land Space Requirements <br /> for permission to vary the front yard depth requirements to construct a <br /> house on property located at 11 River Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> J <br /> a newspaper of general circulation in the Town of Mashpee on March 18, 1980, <br /> and March 28, 1980, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, April 2, 1980 at 8x00 p.m, at which tlme, the following members <br /> of the Board of Appeals were present and acting throughouti Michael Makunas, <br /> Chairman, Robert J. Houle, Raymond G. Sweeney. <br /> The Petitioner indicated to the Board that because of the condition <br /> of the lot, a variance would be required to construct a house, because of <br /> the severe incline. <br /> The Board found that a hardship existed because of the unique <br /> geographical features of the lot. The Board also established that granting <br /> the variance would not be an impact on the Town, and would no� detrimental <br /> to the Town. <br /> Upon motion duly made and seconded the Board' voted unanimously to <br /> grant the Petition for Variance as requested. <br /> MASHPEE BOARD OF APPEALS <br /> BYs <br /> I <br />
