TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> . TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE: Petition of Paul E. Servis for a Variance Case #V-83-4-015 <br /> A Petition was filed by Mr. Servis of Falmouth, Massachusetts <br /> for a Variance to vary the minimum sideline requirement on <br /> property located on Lot 26 Bayview Rd. , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Mass- <br /> achusetts General Laws Chapter 40A. Notice was given by publica- <br /> tion in the Falmouth Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee on April 5, and April 12, 1983 a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, April 20, 1983 , at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: 0Virginia,T:; Landry, Manuel E. Costa Jr. and Michael <br /> a <br /> Makunas. <br /> Mr. Servis explained to the Board that he would like to open <br /> the living room up by putting in sliders with a deck which would <br /> go the length of the house. Mr. Servis then stated that in order <br /> to do this he would need to vary the sideline to 6 feet. <br /> Mr. Makunas pointed out that in order for the Board to grant <br /> a Variance they would have to show a hardship. He also stated he <br /> felt they applied for the right reasons but that the hardship was <br /> self inflicted. <br />
