TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE: Petition of Dr. Chauncey for a-Variance Case #V-83-8-026 <br /> A Petition was filed by Dr. Howard Chauncey of Wellsley <br /> Massachusetts for a Variance to vary the minimum setbacks <br /> required on property located on Lot 36 Wheelhouse Lane, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in the Falmouth Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on July 19, 1983, <br /> and July 26, 1983 a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, August 3 , 1983, at 7:30 p.m. at <br /> which time the •following .members, of the Board of Appeals, <br /> were present and acting throughout : Michael Makuna&, Virginia <br /> Landry, Manuel E. Costa Jr. <br /> Mr. Lynch builder for Dr. Chauncey explained that due <br /> to the Topography (Flood Plain) and lot shape it would be <br /> necessary to vary the minimum sideline requirements. Mr. <br /> Hecht abutter to Dr. Chauncey stated in writing he would <br /> agree to building the deck on his side of the property to <br /> within 11 feet. Mr. Levine Lot 31 has no objection if the <br /> deck area on the East side is changed to 21 and 611 , As per <br /> plans attached and made part of this said decision . <br />
