TOWN OF MASHPEE
BOARD OF APPEALS
TOWN HALL, MASHPEE, MASSACHUSETTS 02649
RE: Petition of Edward R. Wasil for a Special Permit Case #SP-84-3-01
FACTS
A Petition was filed by Edward R. Wasil of Mashpee, Massachusetts
for a Special Permit for permission to operate a Flea Market on property
located on Route 28, Mashpee, Massachusetts, pursuant to Section 6. 3. F. 9
of the Zoning By-Law. Locus is in a C-1 Zone.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee
on March 6, 1984 and March 13, 1984 a copy of which is attached hereto and
made a part hereof.
A public hearing was held, on the petition at the Mashpee Town Hall on
Wednesday, March 21, 1984 at-7:30 p. m. at which time the following members
of the Board of Appeals were present and acting throughout: Michael Makunas,
Manuel Costa and Virginia Landry.
I
Mr. Ray Sweeney attorney for the Wasil's explained that they seek a
special permit to operate said flea market due to an amendment of zoning
by-laws. Mr. Wasil has operated the flea market in town for a number of
years.
The Board noted that a serious traffic problem existed on Saturday
and Sunday, with cars frequently parking on Route 28. It was further noted
by the Board that prior usage of the premises included sleeping overnight in
campers and trailers by transient vendors and other presumed sellers of
merchandise at the flea market.
Mr. Sweeney assured the Board that the applicant would comply with all
requirements imposed by the Board and would caus elands c aping to be done
in accordance with the recommendations of the Design Review Committee and
the requirements of the Board.
The plan of the landscaping, parking, ingress and egress roads and site
of the market was discussed. Mr. Sweeney agreed to secure an estimate of
the cost of the landscaping to assist the Board in arriving at an agreed amount
for a cash surety bond to insure the compliance by applicant with the plans.
The comments and recommendations of the Design Review Committee were adopted
by the Board.
