TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PETITION OF PAUL J. WOODS FOR SPECIAL PERMIT CASE #SP-84-10-042 <br /> FINDING OF FACTS <br /> This is an application for a Special Permit filed by Paul J. Woods of Mashpee, <br /> Massachusetts. The Applicant seeks a Special Permit under Section 6.3.G. <br /> for permission to operate a mini warehouse, with an office, outside storage, <br /> and living quarters for security personnel. He also seeks permission to remove <br /> excess fill but not outside the Town of Mashpee. The property is located <br /> on Route 28, Mashpee, Massachusetts, and is identified as Map 88, Parcel <br /> y; 2A. The title reference is Book 3396, Page 74. The parcel is located in <br /> the industrial business zone. <br /> A copy of the application for the Special Permit is annexed to this decision. <br /> The application was filed with the office of the Town Clerk on September <br /> 24, 1984. The application incorrectly states the present use of premises <br /> in paragraph 9. The present use of the premises is for mini warehousing <br /> only and does not include office, outside storage, or living quarters for security <br /> personnel. Paragraph 11 is ambiguous as it appears to ask for additional <br /> proposed uses of storage and parking for boats, trailers, recreational vehicles, <br /> etc., behind the buildings. For purposes of this hearing it is presumed that <br /> the enumerated uses in paragraph 11 are intended to represent a request <br /> and should have properly appeared in paragraph 10. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws, Chapter 40A. Notice was given by publication in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September <br /> 19 and September 26, 1984, a copy of which is attached hereto and made <br /> a part hereof. <br /> Board members present and voting on this application were Michael Makunas, <br /> William Hanrahan, and Peter Muse. <br /> A public hearing was held on 'Wednesday, October 3, 1984 at 7:30 p.m. at <br /> the Mashpee Town Hall. The Applicant, Paul J. Woods, was present to speak <br /> for the Special Permit application. <br /> Mr. Paul J. Woods appeared before the Board. He explained that there were <br /> two buildings presently existing on the property. There is an office functioning <br /> in conjunction with the mini warehouse and an apartment for security personnel. <br /> The office and the living quarters are not a permitted use by the Town. The <br /> reason for the granting of a permit for the existing buildings for mini warehousing <br /> •, was due to constructive grant by failure of the Board of Appeals to act within <br /> 90 days of the hearing. There is no Special Permit now in existence for <br /> the use of the buildings either as a mini warehouse office or as an apartment <br />�: for security personnel or for outside storage. <br />
