TOWN OF MASHPEE BOARD OF APPEALS TOWN HALL, MASHPEE, MASSACHUSETTS 02649 PETITION OF PAUL J. WOODS FOR SPECIAL PERMIT CASE #SP-84-10-042 FINDING OF FACTS This is an application for a Special Permit filed by Paul J. Woods of Mashpee, Massachusetts. The Applicant seeks a Special Permit under Section 6.3.G. for permission to operate a mini warehouse, with an office, outside storage, and living quarters for security personnel. He also seeks permission to remove excess fill but not outside the Town of Mashpee. The property is located on Route 28, Mashpee, Massachusetts, and is identified as Map 88, Parcel y; 2A. The title reference is Book 3396, Page 74. The parcel is located in the industrial business zone. A copy of the application for the Special Permit is annexed to this decision. The application was filed with the office of the Town Clerk on September 24, 1984. The application incorrectly states the present use of premises in paragraph 9. The present use of the premises is for mini warehousing only and does not include office, outside storage, or living quarters for security personnel. Paragraph 11 is ambiguous as it appears to ask for additional proposed uses of storage and parking for boats, trailers, recreational vehicles, etc., behind the buildings. For purposes of this hearing it is presumed that the enumerated uses in paragraph 11 are intended to represent a request and should have properly appeared in paragraph 10. Notice was duly given to abutters in accordance with Massachusetts General Laws, Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 19 and September 26, 1984, a copy of which is attached hereto and made a part hereof. Board members present and voting on this application were Michael Makunas, William Hanrahan, and Peter Muse. A public hearing was held on 'Wednesday, October 3, 1984 at 7:30 p.m. at the Mashpee Town Hall. The Applicant, Paul J. Woods, was present to speak for the Special Permit application. Mr. Paul J. Woods appeared before the Board. He explained that there were two buildings presently existing on the property. There is an office functioning in conjunction with the mini warehouse and an apartment for security personnel. The office and the living quarters are not a permitted use by the Town. The reason for the granting of a permit for the existing buildings for mini warehousing •, was due to constructive grant by failure of the Board of Appeals to act within 90 days of the hearing. There is no Special Permit now in existence for the use of the buildings either as a mini warehouse office or as an apartment �: for security personnel or for outside storage.
