She had previously submitted a <br /> request for Special Permit seeking the same relief for the same <br /> t location but was required to forego the same when a problem arose <br /> over her ability to secure a lease arrangement with the owner of <br /> the property . She informed the Board that she now had a lease <br /> arrangement . <br /> r The applicant indicated that she would comply with all of the <br /> requirements set forth in her plans ; drawings and specifications <br /> submitted to the Design Review Committee . She further indicated <br /> that the business to be conducted would be for the retail sales <br /> and rental of TV , video and movies . She indicated that she had <br /> no intention of carrying pornographic material in her store and <br /> she submitted a letter to the Board indicating the fact that she <br /> would not offer for rent or sale any pornographic material and that <br /> the films and video movies she offered for sale or rent would be of <br /> L the same type and kind as were displayed by Interstate Theaters in <br /> its cinemas on Cape Cod . <br /> The Board noted that the Locus was in a C-1 business zone and that <br /> the operation of a retail store as sought by the applicant would <br /> not appreciably increase traffic noise or demand when compared <br /> i to the former usage of the Locus as a package store . <br /> Mr . Alan Mendleson the President of Alan Industries , Inc . , also <br /> appeared before the Board and indicated that he was in favor of the <br /> grant of the Special Permit to Margo Wharton . Mr. Mendleson in- <br /> dicated that his pending application for a Special Permit filed <br /> August 9 , 1983 with the Town Clerk could now be acted upon by the <br /> Board. Mr. Mendleson indicated that Margo Wharton would be taking <br /> over the TV, video , movie, rental and sales part of the business <br /> of Alan Industries , Inc. , as the same would no longer be continued <br /> by Alan Industries , Inc. at this location in close .proximity to <br /> the proposed location of Margo Wharton . <br /> t <br /> DECISION <br /> The Board of Appeals unanimously approves the application of <br /> Margo Wharton for a Special Permit pursuant to Section 6 . 3. E. 1 <br />+ of the Zoning By-Law for the operation of a store for the conduct <br /> of a TV, video , movie, rental and sale business , subject to the <br /> restriction that no pornographic material be maintained on the <br /> premises and subject to the compliance by the petitioner with <br /> the installation and maintenance of the landscaping and the <br /> modification of the building and the erection of a sign in <br /> j conformity in all respects with .the plans and drawings and <br /> specifications submitted to and approved by the Design Review <br /> Committee, the same being herein incorporated and adopted by <br />
