Wasil of Mashpee, Massachusetts <br /> for a Special Permit for permission to operate a Flea Market on property <br /> located on Route 28, Mashpee, Massachusetts, pursuant to Section 6. 3. F. 9 <br /> of the Zoning By-Law. Locus, iS in a C-1 Zone. <br /> Notice was duly given to ab tters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on March 6,. 1984 and March 13, .1984 a copy of which is attached hereto and <br /> made a part hereof. <br /> i <br /> A public hearing was held o{ the petition at the Mashpee Town Hall on <br /> Wednesday, March 21, 1984 at '7� 30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Michael Makunas, <br /> Manuel Costa and Virginia Landky. <br /> Mr. Ray Sweeney attorney for the Wasil's explained that they seek a <br /> special permit to operate said Qea market due to an amendment of zoning <br /> by-laws. Mr. Wasil has operand the flea market in town for a number of <br /> years. <br /> The Board noted that a serous traffic problem existed on Saturday <br /> and Sunday, with cars frequently parking on Route 28. It was further noted <br /> by the Board that prior usage oftthe premises included sleeping overnight in <br /> campers and trailers by transie�t vendors and other presumed sellers of <br /> merchandise at the flea market.t <br /> � <br /> Mr. Sweeney assured the B.pand that the applicant would comply with all <br /> requirements imposed by the Beard and would causelandscaping to be done <br /> in accordance with the recommindations of the Design Review Committee and <br /> the requirements of the Board. <br /> i <br /> The plan of the landscaping parking, ingress and egress roads and site <br /> of the market was discussed. Itr. Sweeney agreed to secure an estimate of . <br /> the cost of the landscaping to assist the Board in arriving at an agreed amount <br /> for a cash surety bond to incur the compliance by applicant with the plans. <br /> The comments and recommendations of the Design Review Committee were adopted <br /> by the Board. <br /> J <br />
