TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> rgg CA- <br /> RE: Petition of Robert J. Depietri, Louise M. Depietri and Richard <br /> S. Dubin and Marshall M. Dranetz, Trustees of R&M Realty Trust <br /> for a Special Permit Case #SP-85-07-046 <br /> A Petition was filed by Robert J. Depietri, Louise M. Depietri <br /> and Richard S. Dubin and Marshall M. Dranetz, Trustees of R&M Realty <br /> Trust for a Special Permit for permission to construct a dock in <br /> excess of 45 feet in an R3M zoning district on property located on <br /> Lots 56 & 57, Waterline Drive, Little Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on July 10, 1985 and July 17, 1985, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, July 24, 1985 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Manuel Costa and Michael Makunas. <br /> Mr. Dubin explained that his Order of Conditions was good for <br /> three years from the Conservation Commission, It was also discovered <br /> that they probably did not need a special permit because they did not <br /> exceed the 45 feet, from mean low water the distance is only 44 feet. <br /> The Board had also received a letter from the Conservation Commission <br /> dated July 17, 1985, which states that they are opposed to this request. <br /> At this time the Board asked Mr. Dubin to check with the Conservation <br /> Commission and find out why they were opposed if the dock is 44 feet <br /> from mean low water. Mr. Dubin's Order of Conditions was dated Feb- <br /> ruary 3, 1984, which is the date the Notice of intent for this project, <br /> was filed. The public hearing was closed on February 22, 1984. The <br /> DEQE File No, is SE43-332. At this time the Board requested that Mr. <br /> Dubin return to the Board after speaking with the Conservation Commission. <br />
