t
TOWN OF MASHPEE
BOARD OF APPEALS
b TOWN HALL, MASHPEE, MASSACHUSETTS 02649
DECISION
co-
RE: Petition of Jordan M. Friedman for Variance Case #V-85-05-024
A petition was filed by Jordan M. Friedman of Chestnut Hill,
Massachusetts for a Variance for permission to vary the sideline
and setback requirements on property located on Lot 9 Tide Run, New
Seabury, Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massach-
usetts General Laws Chapter 40A. Notice was given by publication
in the Falmouth Enterprise, a newspaper of general circulation in
the Town of Mashpee on May 8, 1985 and May 15, 1985 a copy of which
is attached hereto and made a part hereof.
A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, May 22, 1985 at 7:30 p.m, at which time the
following members of the Board of Appeals were present and acting
throughout: William Hanrahan, Manuel Costa and Michael Makunas.
Mr. Dranet2 represented Mr. Friedman on this matter andfexplain-
ed that Mr. Friedman had bought this property from Mr. Weiner. Mr.
Weiner had discovered that the engineer had made a mistake in locating
the house, in order to sell the property the mistake was corrected
by filling in a portion of the foundation. Mr. Friedman now wants
to uncover the part of the foundation that had been filled in.
The Board on July 10, 1985 voted to deny this variance because
they felt that Mr. Friedman had bought the hardship and that the
hardship was self-imposed.
