TOWN OF MASHPEE <br /> N BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> • !Ag Ca DECISION . <br /> RE: Petition of George C. Leach for Variance Case #V-85-06-033 <br /> A petition was filed by George C. Leach of Lynnfield, Massach- <br /> usetts for a Variance for permission to vary the setback distance from <br /> private roads on property located on the southwest corner of Mono- <br /> moscoy Road and Overland Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massach- <br /> usetts General Laws Chapter 40A. Notice was given by publication <br /> in the Falmouth Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on June 12, 1985 and June 19, 1985 a copy of <br /> which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, June 26, 1985 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Cheryl Hawver and Thomas Sexton. <br /> Mr. Cain represented Mr. Leach on this matter. Mr. Cain <br /> explained that this lot is bounded on two sides by streets and a <br /> third by Hamlin Pond. Both of the streets are known as paper roads. <br /> Mr. Hanrahan was concerned with an existing summer cottage shown <br /> on the plans. The Board found no problem with the variances on the <br /> proposed building but -they did have a problem with the accessory <br /> building. Building Inspector Douglas Boyd explained to the Board <br /> that an accessory building is allowed if-fit is an accessory building,, <br /> no habitation and no kitchen. <br /> Mr. Leach told the Board that he intended to use the building <br /> as a summer guest house, it would not be rented to a third party. <br /> He said that it would be an accessory building used for habitation. <br /> The Board felt that in a way they were creating their own <br /> hardship by building the second building, then the other one becomes <br /> the accessory building and that doesn't conform to the by-law. <br /> `f <br />
