DECISION <br /> RE: Petition of Selim & Susan Kurtoglu for a Variance Case #/-86-03-020 <br /> A Petition was filed by Selim & Susan Kurtoglu of Mashpee for permission <br /> to vary the sideline requirements in a Residential zoning district an property <br /> located on Lot 33, Deerfield Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> Laws, Chapter 40A. Notice was given by publication in the Falmouth Enter- <br /> prise, a Newspaper of general circulation in the Town of Mashpee on February <br /> 26 and March 5, 1986. A copy of which is attached hereto and made a part. <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 12, 1986 at 7:30 p.m. at which time the following mem- <br /> bers of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Cheryl Hawver and Peter Lawrence. <br /> The Board recognises that the Kurtoglus have no choice as to the posi- <br /> tioning of the addition. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant a 10 ft Variance of the sideline as requested due to a hardship im- <br /> posed on by the shape of the lot and that granting the Variance would be <br /> in harmony with the general purpose and intent of the ordinance or By-Law. <br /> It was noted that a letter received from Ann Shaw, Trustee of the <br /> Deerfield Acres Trust was in favor of the Variance request. <br />
