TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> e , TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE : Petition of Richard Buonopane for a Variance Case #V-86-01-001 <br /> A petition was filed by Richard Buonopane of Revere , Massachusetts <br /> for a Variance for permission to vary the rear setback requirements <br /> in an R-3-M zoning district on property located on Lot 65 , Ashumet Road , <br /> Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on December 23 , 1985 and December 30 , 1985 a copy of which is <br /> attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , January 8 , 1986 , at 7 : 30 p . m. at which time the following <br /> members of -the Board of Appeals were present and acting throughout : <br /> William Hanrahan , Michael Makunas and Cheryl Hawver . <br /> 'Stephanie Meilmen represented this application as she had purchased <br /> this property from Mr . Buonopane on December 26 , 1985 . After hearing <br /> the facts concerning this application it was the Board ' s feeling that <br /> in an effort to s.et the house away from the highway as much as possible , <br /> it created-!a situation similar to having a topographical hardship . <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant the variance to allow a deck to be built within six (6 ) feet of the <br /> rear lot line as shown on the drawing .
