MA 02649 <br /> DECISION <br /> RE: Petition of Angelo & Thalia Toyias for a Special Permit Case <br /> #SP-87-03-028 <br /> A Petition was filed by Angelo & Thalia Toyias of Mashpee, Mass- <br /> achusetts for a Special Permit for permission to construct a timber <br /> stairway, pier, gangway and float in a R-3M Zoning District on property <br /> located on 44 Wheelhouse Drive (lot 156) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the - <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on February 25 & March 4, 1987, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, March 11, 1987 at 7:30 p.m. at which time the follow- <br /> ing members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Cheryl Hawver and Thomas Sexton. <br /> The Board was informed the pier wil extend a distance of sixteen <br /> feet from the mean low water mark. Information was received that a <br /> small boat will be moored at. the dock and will be utilized for recrea- <br /> tional use only. No objections were voiced by abutters present. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on March 11, 1987 to grant the Special Permit as requested <br /> with the stipulation this applicant comply with all "Orders of Conditions" <br /> setforth by the Mashpee Conservation Commission. <br />
