MA 02649 <br /> DECISION <br /> RE: Petition of Joseph Tarabelli for a Variance Case #V-87-03-027 <br /> A Petition was filed by Joseph Tarabelli of Mashpee, Massachusetts <br /> for a Variance for permission to vary the front and sideline setback <br /> requirements in a R-2 Zoning District on property located on 88 Mizzen- <br /> mast, Little Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachu- <br /> setts General Laws Chapter 4OA. Notice was given by publication in <br /> the Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on February 25 & March 4, 1987, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 11, 1987 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Cheryl Hawver and Thomas Sexton. <br /> Council, representing the Applicant, explained to the Board that <br /> the Applicant is proposing to construct a 22 x 22 foot garage. Thru <br /> information received the Board learned the owner of the abutting lot <br /> requests the Applicant construct the garage on the opposite side of <br /> his home to protect the trees in that area and because obstruction of <br /> the view from his dining area would occur if the proposed garage were <br /> constructed there. The Board could not establish the basis for a hard- <br /> ship due to the alternative location on the lot, which would be func- <br /> tional, accessable and would meet all zoning requirements. <br />
