MA 02649 <br /> DECISION <br /> RE: Petition of John Malloy for a Special Permit Case #SP-87-04-032 <br /> A Petition was filed by John Malloy of Mashpee, Massachusetts for a <br /> Special Permit for permission to construct a walkway, dock, ramp and float <br /> and construction of a single family dwelling in flood plain A in a R-3M <br /> Zoning District on property located on lot 166 Whippoorwill Circle, (map <br /> 125, parcel 151 ) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> March 18 & 25, 1987, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, April 1 , 1987 at 7:30 p.m. at which time the following mem- <br /> bers of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Cheryl Hawver and Thomas Sexton. <br /> Opposition was voiced from abutters present in regards to the leach- <br /> ates seeping from the septic system into the Great River and their ground <br /> water supplies. Written opposition was received from the Mashpee Conserva- <br /> tion and Shellfish Commissions. Town Council informed the Board the <br /> applicant has applied for incorrect relief from the Mashpee Zoning By-Laws. <br />
