MA 02649 <br /> DECISION <br /> RE: Petition of Joseph DeMambro for Variance Case #V-87-05-052 <br /> A Petition was filed by Joseph DeMambro of Mashpee, Massachusetts for a <br /> I <br /> Variance for permission to vary the front setback requirements, to build within <br /> 50 feet of the wetlands and to build within the A.C.E.C. district on property <br /> located on 750 Little Neck Lane, New Seabury, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on May 13 & 20, 1987, <br /> a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, May 27, 1987 at 7:30 p.m. at which time the following members of <br /> the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Manuel Costa and Michael Makunas. <br /> Through information provided by the Conservation Commission the Board <br /> learned the proposed dwelling is not within the A.C.E.C. distirct and deter- <br /> mined a front setback Variance is not required as the proposed house meets <br /> the twenty-five foot zoning setback requirements of the Town. The Board <br /> established the hardship to be in the shape of the lot. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on July 29, 1987 to grant the Variance of 10 feet into the wetlands <br /> area as requested. <br />
