Cohen for a Special Pemrit Case #SP-87-05-051 <br /> A Petition was filed by Harold J. Cohen of Mashpee, Massachusetts for <br /> a Special Permit for permission to construct and maintain a pier, ramp and <br /> float in a R-3 Zoning District on property located on 65 Keel Way, Little <br /> Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> May 13 & 20, 1987, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, May 27, 1987 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Manuel Costa and Michael Makunas. <br /> The Board was informed the proposed dock is twenty-five feet from mean <br /> low water, will extend twenty feet over the marsh and elevate five feet along <br /> the marshland. Objections were raised by the Mashpee Harbormaster however, <br /> thru information provided by the Applicants Counsel the Board learned that <br /> the proposed dock would not impede navigation in the area. Information was <br /> received that the construction of docks over New Seabury' s easements are a <br /> permitted use. The Board established that granting this Special Permit woul <br /> be in harmony with the general purpose and intent of the ordinance or By-Law. <br />
