Page <br /> The facts presented to the Board indicated that the Applicant did <br /> not construct his dwelling in conformance with the plans submitted to <br /> the Building Inspector and the Conservation Commission and the Board of <br /> Health. The facts also indicate that the Applicant has other options <br /> available for use of lot 14 for construction of a dwelling other than <br /> the existing construction or the design setforth on his plan submitted <br /> to the Board which existing construction and design the Board finds to <br /> be harmful to the Mashpee River. <br /> The Board voted unanimously to deny the request for variance without <br /> prejudice on the basis of failure of the Applicant to show that a grant <br /> of the variance would not constitute a substantial detriment to the public <br /> good, would not substantially derogate from the intent and purpose of <br /> Section 11A, and would not constitute a substantial hardship. <br /> BY: <br /> MASHPEE BOARD OF APPEALS <br /> TO DENY °`� <br /> i4iaHanraha <br /> TO DENY /�G ✓ <br /> Mich el Mak nas <br /> TO DENY <br /> and Govoni <br /> This decision has been duly filed on December 1987 <br /> with the Town Clerk of Mashpee.
